Standard Terms and Conditions for Sales and Business Operations of PMK Polomaker Co., Ltd.

The following terms and conditions apply to all types of goods and services provided by PMK Polomaker Co., Ltd. They are divided into categories of products and related conditions to comply with business standards in Thailand.

1.Product and Service Types

  • Made-to-order Products: Products manufactured according to customer specifications, with clear details on design, color, material, and quantity required.
  • Retail Products: Ready-made products sold by the company without additional customization.
  • Retail Products with Added Embroidery/Screen Printing Services: Ready-made products that customers can customize with embroidery or screen printing.

2. Order Confirmation

  • Orders are considered confirmed once the company receives written confirmation from the customer and the deposit specified in the product-specific terms. If not followed, the customer forfeits any right to claim if the order is canceled.

3. Payment Terms

  • For made-to-order products and retail products with added services (e.g., embroidery or screen printing), customers must pay a deposit of no less than 50% of the total value at the time of order confirmation. The remaining balance must be paid before product delivery. The deposit amount will be specified in the quotation and depends on the type and quantity of goods ordered. Bank transfer fees are the responsibility of the customer.
  • For retail products, customers must make full payment before delivery.

4. Order Cancellation and Product Return/Exchange

  • Once the customer has confirmed an order, it cannot be canceled. If the customer wishes to cancel the order or contract, the company reserves the right to retain the full deposit. If additional costs arise from product preparation or production, the company reserves the right to claim compensation for actual incurred expenses.
  • For defective or damaged retail products, customers can request an exchange within 7 days of receiving the product, provided it has not been used and is in its original condition with complete packaging. Exchange requests must be made through the branch or channel where the purchase was made, along with proof of purchase (receipt). If the replacement product is out of stock, the company reserves the right to offer a similar product or refund the full amount.

5. Delivery and Risk

  • The delivery time provided is an estimate only, and the company is not responsible for delays caused by force majeure or factors beyond its control (e.g., natural disasters, transportation delays). Responsibility for the goods transfers to the customer once they are handed over to the carrier.

6. Warranty and Returns

  • The company guarantees that the products are free from material defects and manufacturing faults under normal use for 7 days from the date of receipt. If a manufacturing defect is found, customers can request an exchange as per the conditions in Section 4. This warranty does not cover damages caused by misuse, alterations, or accidents.

7. Intellectual Property

  • All intellectual property rights related to designs, logos, or other works created during the product manufacturing process belong to PMK Polomaker Co., Ltd. Customers are only permitted to use them for the agreed-upon purpose. Transfer of these rights to third parties without written approval from the company is prohibited.
  • For patterns, logos, or any other designs provided by customers for product manufacturing, the company is not liable for any intellectual property violations. The customer will be solely responsible for any legal consequences arising from the use of such materials.

8. Limitation of Liability

  • The company is not responsible for any direct or indirect damages resulting from the use of products beyond the specified limits or if the customer uses the products improperly.

9. Dispute Resolution

  • In the event of a dispute arising from this agreement, both parties agree to resolve the matter through arbitration, following the rules of the Thailand Arbitration Center. The arbitration decision is final. If either party fails to comply with the decision, legal action will be pursued.

10. Amendments to Terms

  • The company reserves the right to amend these terms and conditions as appropriate, with prior notice to the customer. Amendments will apply to orders placed after the effective date of the revised terms.

11. Governing Law

  • These terms and conditions are governed by the laws of Thailand. Any interpretation and dispute must be settled under Thai law.
